Partner Visa (Temporary)

Subclass 820

This visa allows your de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen to live in Australia temporarily. This is visa category for onshore applicant. Applicants will first obtain this temporary visa Subclass 820, and a permanent visa Subclass 801 will be granted after 2 years.

  • If you are married applicant, you need to have a marriage certificate recognised by Australian laws, and maintain the marriage relationship during the visa application processing time.

  • If you are de facto applicant:

    • Both parties are over 18 years old; there is no family relationship between (such as adoption, common parents)

    • In the de facto relationship at least 12 months, and maintain the relationship during the visa application processing time.

    • If the de facto relationship is less than 12 months, immigration affair may consider special conditions.

    Eligibility:

    • Be aged over 18

Partner Visa (Permanent)

Subclass 801

This visa allows your de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen to live in Australia permanently. It is usually only for people who currently hold a temporary Partner Visa (Subclass 820). Applicants will first obtain temporary visa (Subclass 820), and this permanent visa (Subclass 801) will be granted after 2 years.

  • If you are married applicant, you need to have a marriage certificate recognised by Australian laws, and maintain the marriage relationship during the visa application processing time.

  • If you are de facto applicant:

    • Both parties are over 18 years old; there is no family relationship between (such as adoption, common parents)

    • In the de facto relationship at least 12 months, and maintain the relationship during the visa application processing time.

    • If the de facto relationship is less than 12 months, immigration affair may consider special conditions.

* Visa Application fee is paid when you submitting the Temporary Partner Visa (Subclass 820).

Partner Visa (Provisional)

Subclass 309

This visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia temporarily. This is visa category for offshore applicant. Getting this visa is the first step towards a permanent Partner visa (Subclass 100). Generally, applicants will first obtain this temporary visa (Subclass 309), and a permanent visa (Subclass 100) will be granted by meeting some conditions after 2 years.

  • If you are a married applicant, you need to have a marriage certificate recognised by Australian laws, and maintain the marriage relationship during the visa application processing time.

  • If you are a de facto applicant:

    • Both parties are over 18 years old; there is no family relationship between (such as adoption, common parents)

    • In the de facto relationship at least 12 months, and maintain the relationship during the visa application processing time.

    • If the de facto relationship is less than 12 months, immigration affair may consider special conditions.

Partner Visa (Migrant)

Subclass 100

This visa allows your de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen to live in Australia permanently. It is usually only for people who currently hold a provisional Partner Visa (Subclass 309). Applicants will first obtain temporary visa (Subclass 309), and this permanent visa (Subclass 100) will be granted after 2 years.

  • If you are married applicant, you need to have a marriage certificate recognised by Australian laws, and maintain the marriage relationship during the visa application processing time.

  • If you are de facto applicant:

    • Both parties are over 18 years old; there is no family relationship between (such as adoption, common parents)

    • In the de facto relationship at least 12 months, and maintain the relationship during the visa application processing time.

    • If the de facto relationship is less than 12 months, immigration affair may consider special conditions.
